The purpose of a title
search is to examine pertinent
records to disclose the current status of the legal
title which is the subject of the sale.
The Title search provides the basis and the
information necessary to enable the transaction
to be consummated with marketable title being
transferred from seller to
purchaser.
Search of public records for matters affecting the
title to the real estate concerned is the first step.
The search is intended to reveal and report upon
all material objections to the title. The purpose of the
title search is to disclose land title problems, such
as unpaid taxes, workmen's liens, unsatisfied
mortgages and other charges against the property.
The title search itself consists of a personal
and thorough review of the documentation in
the county courthouse in which the property is located.
Deeds, mortgages, liens and judgments of prior owners
of the property are examined to determine that
the property passed from
one party to another.
A complete title search
discloses any claims against the
property as well as the existence of any easements or
restrictive covenants that may affect the properties use.
Courthouse records are examined for that information
for the past 60 years.
In addition to the work in
the courthouse, other sources
of information are
contacted such as taxing authorities,
pertinent utilities and
community associations.
